      By the way how comes that people and organisations with the only purpose to prosecute users in gaytor.rent are allowed to access the site? Why aren't their accounts disabled?

          @john32123666 That's not what I am questionning. So it should be, but when an account is identified to be created and upheld only for tracking DMCA then it should be banned just as they ban all the other "fraudsters". The reason being that every single torrent here breaks DMCA rights.

            @jujulette That's a question that appears over and over again, and nobody has ever been given a definitive answer, I would postulate that there is a very good reason for this and the best approach is to simply accept it for what it is and try not to think about it.

              @semurg30 You were not singled out. I'm on my third 90-day ban. It actually should have ended days ago but for some reason, I still cannot access the upload page. This is fine because I never intend to upload another torrent, I'll just keep my ratio up by seeding stuff I leech.

              But to your comment, the thing I don't understand is this. Multiple DMCA complaints get you suspended and people have stated it is because the site's hands are tied and they need to make the violators a lesson. Well, how do the reporters even know who uploaded their material? When you get a violation notice it states:

              Be assured this notice was sent to us, the website, and does not involve their seeking out information about the uploader. In any case, we would never reveal information about our users or their accounts.

              So which is it? Do the complainers know who uploaded their file or don't they?

                @duncanlem AKAIK they don't, but when a DMCA notice is received the site operators are probably required to take some sort of action against the individual that uploaded the file. This can happen in the background without ever divulging the member's details to the copyright owner. Perhaps it's a deal struck with the industry that stop them from bringing all they have against the site as a whole, but speculation is just pointless.

                Once again, I'd say that the reason things happen the way they do is probably because they have to happen that way. Asking questions here yields no meaningful answers, and I assume that is also because it has to be that way. I'd suggest that we all just accept it and not try to delve too deep into something that is presumably there to protect both the site and its members.

                  Not asking the right questions, just accepting everything means that one day this site is going to be down. Either by external or internal forces. Because at one point if your torrents constantly keep on getting down you will just stop uploading or visiting the site.

                    Sure.
                    Had it occurred to you that the site owners have heard all of the arguments over the years the site has been up, and maybe that's one of the reasons discussing those policies is not allowed?
                    I think this is a situation where there is no ideal answer. So we have rules the site owners think are best for the site.

                        @tnar That sounds good.. but it is not accurate.
                        Many torrents are taken down within a minute of being uploaded - in an automated way. No DMCA notice was ever sent in.
                        Also, a senior moderator of this site had a video he made of HIMSELF taken down for DMCA reasons.

                        My 90 day suspension was never lifted.

                        Then there is the issue of gay porn not covered by any copyright protection, because you cannot copyright something that is obscene, and shoving one's erect penis into a rectum is considered obscene.

                            No and yes. The rules page ( https://www.gaytor.rent/notallowed.php ) lists types of material than can't be uploaded (e.g, under-age, bestiality, drug use). No studio names are listed except those known to to have many under-age models.

                            There are other studios (that I won't name) that are very vigourous in sending in DMCA requests that their stuff be taken down. (I can think of several, but I'm not going to name them.) The operators of this website know who those studios are, but don't use their names on the banned list for reasons that are probably complex, confidential, and necessary to keep the site operating.

                            It's entirely possible that an uploading ban could come about if a person repeatedly uploads material from these hyper-vigilant studios and gets notified over and over again that their stuff has been subject to a DMCA takedown. This is speculation on my part, and can't be confirmed or denied by a moderator--but I think it makes sense.
