To me this sounds very much like a law working exactly as it was intended. Even though it doesn't protect against incitation, what is considered incitation is still havily subjective.
I wouldn't move a finger to defend Hasan as I never really liked him, precisely for the way he incites violence whilst making a ton of money and living a pretty comfortable life that doesn't require him to actually do any of the things he say people should do.
It's not that I disagree on the premise of violence as a means to fight oppression, I just find it too hypocritical that the people who are most vocal about it usually make a money out of it and are never an example of what they're saying. This is not a particularity of Hasan or leftists in general, but the reality of most people who make money through Politics, be it an actual Politician, commentators or whatever.
It is indeed poetical that he's being sued by that guy of all people, I do hope he wins because I am curious to see if the American Jewish Committee will say the entire US judiciary system is antisemite, or if it's just that one judge in particular.
