does the upload still count when the torrent is "not working"

I'm seeding a torrent, and it says the torrent is not working(I checked, it's been taken down), but it's still uploading, does the upload count in this case? Thank you.

@freddie7 unfortunately not. Once it get DMCA'ed the tracker will refuse any connections about this torrent
