<?xml version="1.0" encoding="UTF-8"?><rss xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:content="http://purl.org/rss/1.0/modules/content/" xmlns:atom="http://www.w3.org/2005/Atom" version="2.0"><channel><title><![CDATA[Ohio State Supreme Court sides with mailbox owners]]></title><description><![CDATA[<p dir="auto">The Ohio State Supreme Court has ruled that landowners are not liable for injuries of those injured by their mailboxes, even if the mailbox is fortified.</p>
<p dir="auto">The majority said that even though mailboxes are on the public "right of way" (aka public easement), it is not on a part that is normally traveled on by vehicles, therefore there is no duty of care toward vehicles and their occupants.</p>
<p dir="auto">In a previous case, it was decided that mailbox owners had no duty of care to cyclists, pedestrians, etc, as long as the mailboxes are legally placed.</p>
<p dir="auto">To recap;</p>
<p dir="auto">In Ohio, as long as you legally place your mailbox, you have no further duty of care.</p>
<p dir="auto">Other states may have different laws and/or rulings.</p>

<p dir="auto">The driver of the truck was injured.  I think he became paralyzed.</p>
<p dir="auto">He was speeding around a corner, hit black ice, and hit 2 mailboxes, one of which was the one in question.</p>
