A little alcohol loosens inhibitions and impairs judgment.  Enough alcohol, sure they would not even know who they are with or what is going on around them or remember anything the next day but at that point they probably couldn't actively engage in sexual intercourse.

And if you don't know how many drinks that person had nor know that person, then they could definitely exhibit behavior that's outside their normal sober interactions. So it can be an incredibly difficult situation. Be careful.
